Article 1 (Acceptance of Terms and Conditions)
This Terms of Use Agreement (hereinafter referred to as the "Agreement") sets forth the terms and conditions for the use of the kotofuku website (the "Website") operated by Wonect, Inc. (the "Company"). Please read the following before logging into the Website or using any of the services provided by the Website (hereinafter referred to as the "Services"). By clicking the "I agree" button, or by continuing to complete the account activation process, or by continuing to browse the Website, or by using the Services, you acknowledge that you have read and agree to the terms and conditions set forth below.
Article 2 (Amendments)
The Company reserves the right to change this Agreement without obtaining your consent when it deems it necessary. By posting the revised Terms of Use on the Website, the customer is deemed to have agreed to the revised Terms of Use.
Article 3 (Handling of Personal Information)
We will handle your personal information in accordance with the provisions of the Privacy Policy on this Website.
Article 4 (Use of the Service)
All customers shall use the Service in accordance with this Agreement and rules determined by the Company.
Article 5 (Prohibitions)
1. You shall not engage in any of the following acts when using the Service. If you violate any of the following items and cause damage to the Company or a third party, the Company may demand compensation from you for the damage suffered by the Company. In addition, the Company may suspend your use of the Service or delete your account.
(1) Infringes the copyright or other intellectual property rights of the Company or any third party
(2) Infringes the property, privacy, etc. of the Company or any third party
(3) Defame, slander, or threaten the Company or any third party.
(4) Transmitting or writing harmful computer programs, etc.
(5) Any act that causes disadvantage to a third party or is inappropriate.
(6) Use the Service for commercial purposes.
(7) Actions that offend public order and morals.
2. We may suspend your use of the Service or delete your account if we determine that you belong to or are affiliated with antisocial forces or similar groups.
Article 6 (Intellectual Property Rights)
Copyrights and other intellectual property rights related to photographs, trademarks, graphic files, images, and other content (hereinafter referred to as "Content") provided through the Service shall belong to the Company and Content providers, and customers shall not reproduce, reprint, modify, or otherwise make secondary use of the Content without the Company's consent.
Article 7 (Order and Delivery)
1. With respect to delivery of goods, the Company shall designate a logistics provider to deliver the goods to customer. By shipping and delivering the goods through the logistics provider designated by the Company, the Company shall fulfill its obligations to provide the goods and to deliver the goods to the Customer.
2. The sales contract between the Company and the customer shall be concluded after the fees have successfully been paid by the customer. However, the customer agrees in advance to the following:
(1) Even if a good is in stock on the Website and can be placed in the shopping cart when the customer places an order, the good may not be in stock at the time of subsequent payment and the payment cannot be completed.
(2) Even after payment is completed, some or all of the goods may be out of stock due to the difference between the inventory status displayed on the site and the actual inventory status. In such cases, we will refund your money. If you order a partially out-of-stock item, the system will not allow us to deduct the amount of the out-of-stock item, so all orders that include the out-of-stock item will be canceled. If you wish to purchase any items other than the out-of-stock items again, you will need to place a new order.
(3) Once an order has been placed, it cannot be changed (size, color, quantity, etc.) or be canceled.
(4) Due to different calculations and quality standards in Japan and overseas, the standards may differ from those of the country or region where the customer is located, but this does not mean that there is a quality problem. Also, please be aware that some goods may be mixed with other goods due to the influence of our suppliers.
3. Under normal circumstances, the order will arrive within 10 to 14 business days after the customer's order is placed. However, delivery may be delayed due to order details, inventory status, peak season, natural disasters, etc.
4. When placing an order, customers are required to research in advance the import laws, regulations, and prohibited items in the country or region to which the goods will be delivered. The customer expressly understands and agrees that even if the products ordered by the customer are confiscated or taxed in the country or region of the delivery destination specified by the customer, the Company shall not be liable therefor (nor shall the Company refund the aforementioned product price or shipping costs to the customer) and that the customer shall bear such responsibility. You expressly understand and agree that the Company shall not be liable for any loss or damage arising out of or in connection with the sale of goods.
Article 8 (Customs Duties, Export Certificates, etc.)
1. The Company shall bear the customs duties imposed on our goods. However, in the case of overseas shipments, additional charges may be incurred by the customs office of the destination country. In this case, the customer is responsible for any additional charges. Customers are responsible for contacting customs themselves to complete the necessary procedures.
2. If a parcel of goods cannot clear customs because the customer refuses to follow the relevant procedures or make payment, the parcel will be destroyed by the local customs and the price of the goods and logistics fees will not be refunded.
3. We do not issue export certificates such as certificate of origin or export visas.
Article 9 (Returns and Exchanges)
1. Even if a return or exchange is possible, if the customer does not follow the procedures set forth in the paragraphs of this Article, the Company may not proceed with the return or exchange.
(1) In the case of returns due to reasons attributable to the Company, including the following items listed i through iii, The Company shall bear the shipping costs for returned goods:
i. When the delivered goods are different from the ordered item (wrong shipment).
ii. When the delivered goods have a manufacturing defect.
iii. When the delivered goods are defective or unsuable.
(2) If none of the items in (1) applies, the Company shall not process the return as if it were due to reasons attributable to the customer.
2. In cases where a return or exchange is permitted under the preceding paragraph, when the customer requests a return or exchange, the customer shall contact the Company by e-mail within 7 days of receipt of the goods, describing the goods to be returned or exchanged. In the unlikely event that the goods are damaged or inadequate in quantity, the customer shall take photographs of the goods and parcel, save a video or photograph of the opening of the package, and submit an after-sales service application form to the Company. If the Customer discovers damage to the goods after signing and verifying the receipt but is unable to provide the evidence required by the Company, the Company shall not be liable for such damage. After customer service receives the application, the Company will contact the customer individually for follow-up. In the event of damage to goods caused by logistics, customers are requested to contact the logistics company themselves.
3. Refunds for goods and shipping charges will be made using the payment method used to pay for the goods and shipping charges. In the case of payment by credit card, the product price and shipping charges may differ from the amount at the time of payment due to the exchange rate at the time of refund. As a result, there may be a foreign exchange loss or gain in the amount of refund received by the customer. Even in the unlikely event of a foreign exchange loss, the customer cannot demand that we refund the foreign exchange loss. In addition, due to credit card deadlines and payment dates, it may take up to two months for a refund to be issued.
Article 10 (Website Management and Operation)
In order to maintain good operation of the Service, the Company may, in any of the following cases, suspend or discontinue all or part of the Service provided without prior notice to customers. The Service uses SSL (a function that prevents data interception and tampering by encrypting SSL communications) encryption on pages where personal information is sent and received, making it impossible for a third party to intercept the customer's personal information. In addition, all servers related to this service are protected by firewalls to prevent unauthorized access by third parties. In the unlikely event of unauthorized access attempting to breach the firewall, it can be detected and blocked in advance:
(1) In the event of periodic or emergency maintenance of the computer system used to provide this service.
(2) When system operation becomes difficult due to fire, earthquake, flood, lightning, snow, power outage, natural disaster, etc.
(3) When system operation becomes difficult due to system failure, unauthorized access from third parties, virus infection of machines, etc.
(4) When requested by administrative or judicial authorities based on reasonable grounds.
(5) In any other cases where we deem it necessary to suspend the system.
Article 11 (Disclaimer)
1. The Company shall not be liable for any direct or indirect damages incurred by you even if the Service is temporarily suspended, discontinued, or modified due to a natural disaster or other unavoidable technical reasons.
2. If you cause any damage to other customers or third parties as a result of using the Service, you shall settle the matter at your own responsibility and expense and compensate us for any and all damages incurred by us as a result of such use.
3. The Company shall not be liable for any consequential, special, incidental, or indirect damages incurred by you, and the Company's liability for damages incurred by you as a result of your use of the Service shall be limited to direct and actual damages caused by reasons attributable to the Company or the Company's breach of its obligations under the Terms of Use. Our liability for damages shall be limited to direct and actual damages caused by reasons attributable to us or our breach of our obligations under these Terms of Use. Our obligation to compensate for damages shall be limited to the price of the ordered product at the time the damage occurred.
4. Our company shall not be liable for any problems with the use of this service due to the customer's usage environment.
Article 12 (Governing Law and Exclusive Jurisdiction)
The laws of Japan shall apply to the interpretation of this Agreement and to disputes. Any dispute arising out of this Agreement shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's head office. In the event of any discrepancy between the Japanese version and any other language version of this Agreement, the Japanese version shall prevail.
These Terms and Conditions are applicable on and after April 1, 2024.
